As OAN Health Natural Food Products Trade Limited Company (“OAN Health”), we process your personal data in accordance with the Personal Data Protection Law No. 6698 (“KVKK”) and related regulations, and we make every effort to protect your data by taking the necessary technical and administrative measures as stipulated by law. With this OAN Health Customer Clarification Text (“Clarification Text”), we aim to inform you in detail about the processing of your personal data.

In this context, OAN Health processes your personal data within the framework of the principles stated in Article 4 of the KVKK, by taking all necessary technical and administrative measures, in accordance with the Constitution of the Republic of Turkey, international agreements to which our country is a party, and all legislation related to the protection of personal data, primarily KVKK:

  • Compliance with the law and rules of honesty,
  • Being accurate and, when necessary, up-to-date,
  • Processing for specific, explicit, and legitimate purposes,
  • Being relevant, limited, and proportionate to the purposes for which they are processed,
  • Being retained for the period stipulated in the relevant legislation or necessary for the purposes for which they are processed.

 

 

PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data, which will be processed automatically through our Website or mobile application during your product and/or service purchase transactions performed by creating an order with or without membership to our website https://www.oanhealth.com, include:

  • Your name and surname, which are considered identity data, for the purposes of executing and terminating the distance sales contract, processing orders, delivering products and/or services to you, invoicing your purchase, and communicating with you regarding your purchase, creating transaction records, and managing customer identification processes (KYC),
  • Your email address, phone number, delivery address, and billing address, which are considered communication data, for the purposes of executing and terminating the distance sales contract, processing orders, delivering products and/or services to you, creating transaction records, invoicing your purchase, communicating with you regarding your purchase, requests and complaints, making notifications about your order/delivery/shipping to your email address and/or phone number, and ensuring customer satisfaction,
  • Information about the product(s) you purchased, quantity and amount information, order note, and payment method, which are considered customer transaction data, for the purposes of executing and terminating the distance sales contract, invoicing your purchase, creating transaction records, preparing your order based on your order note, performing payment transactions, and for marketing processes of products or services including profiling based on your interests and preferences, sending you discounts and campaigns for products suitable for your interests and preferences, and conducting marketing analysis studies.

The name on the card, card number, card expiration date, and card CCV number for your purchases made using the “Credit Card Payment” method are not processed by OAN Health; the payment transaction is carried out by the relevant payment institutions we have contractual relationships with.

 

 

METHOD AND LEGAL BASIS OF COLLECTING YOUR PERSONAL DATA

Your personal data is collected, in whole or in part, by automatic means through:

  • Your visit to our Website and the transactions you perform during your visit,
  • Cookies on our Website,
  • The information you provide through the Form on the ‘Contact’ page on our Website,
  • Your email address provided via the E-Newsletter Registration section,
  • Your purchase of the products and/or services offered on our Website.

Your personal data, provided for processing purposes and obtained through these methods, will be processed based on the legal grounds stated in Article 5 of KVKK, such as:

  • The necessity of processing your personal data for the establishment or performance of the Distance Sales Contract within the scope of product and/or service supply,
  • The necessity of processing personal data for OAN Health to fulfill its legal obligations,
  • The necessity of processing data for the establishment, exercise, or protection of a right,
  • The necessity of processing personal data for the legitimate interests of OAN Health, provided that it does not harm your fundamental rights and freedoms,
  • Your explicit consent regarding the processing activities of personal data for sending commercial electronic messages to you.

 

 

TRANSFER OF YOUR PERSONAL DATA

Your personal data may be transferred to:

  • Lawyers, auditors, tax consultants, and other third parties from whom we receive consultancy and services; to carry out our business processes in accordance with the law and our legitimate interests, to exercise our right of defense in a possible judicial process,
  • Your authorized representatives; to fulfill our legal obligations,
  • Regulatory and supervisory authorities, courts, enforcement offices, and other official institutions and other public institutions or organizations authorized to request your personal data; to fulfill our legal obligations,
  • Our business partners and service providers; to maintain, improve, and develop our services, infrastructure, and security processes,

within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK.

YOUR RIGHTS REGARDING THE PROTECTION OF YOUR PERSONAL DATA
Regarding your personal data, you have the right to:

  • Learn whether personal data is processed or not,
  • Request information if your personal data has been processed,
  • Learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • Know the third parties to whom personal data is transferred domestically or abroad,
  • Request the rectification of incomplete or inaccurate data,
  • Request the deletion, destruction, or anonymization of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
  • Request notification of the transactions made pursuant to subparagraphs (d) and (e) to third parties to whom personal data has been transferred,
  • Object to the processing, exclusively by automatic means, of your personal data, which may result in an adverse decision for you,
  • Request compensation for the damage arising from the unlawful processing of your personal data.

You can submit your requests within the scope of the rights specified above by sending them via registered mail with return receipt, in person, through a notary public, or via registered electronic mail (KEP) address, secure electronic signature, mobile signature, or using the email address you have previously notified us and is registered in our system, to [email protected] or Esentepe Mh. Your request will be answered in accordance with the relevant provisions of the KVKK, and OAN Health may request some verifying information from you to confirm that the applicant is the relevant person. This information will only be requested to identify the applicant and share the results of the application with the correct person.
